Question

My ten year ild son has just been diagnosed with Bipolar disorder. H also as Prader Willi syndome. I myself am diabeled with MS and Bipolor syndrome. I have not had a manic attack in the last ten years and see a therapist. My husband blames my son's mental illness on me stating it must be my son's enviroment that is causing his bipolar disorder and he now wants full custotdy of my son. I am married, have provided my son with a stable home - We live in north dakota. Should I be worried?

Good morning,

I'm sorry to hear of your dilemma.

Your ex is full of bologna. He will never convince a court that you are an unfit mother and take custody of your son from you. Generally, a parent may be deemed unfit if they have been abusive, neglectful, or failed to provide proper care for the child. A parent with an untreated mental disturbance, or an addiction to drugs or alcohol, may also be found to be an unfit parent. Failure to visit, to provide support, or incarceration of a parent are other examples of grounds for being found to be unfit.

Your bipolar disorder, which is fully under control medically, will not provide the basis for a change in custody under the laws of North Dakota.
