Question

I have a person who is staying in my house in a spare room for 30$ a week. I gave her a 10 day written notice of eviction, and understand that at the end of ten days I need to file for an act of possession to have her removed. We have no written agreement, just a verbal. Now she has said to other people in my home that she is planning to destroy much of my property before leaving, including major appliances, the walls and structure, defacing the outside of the property, and my personal belongings. I live in Hamilton County in Tennessee. Do I have any recourse legally aside from just waiting for it to happen? It may be noteworthy that I do strongly believe her to be a violent person, and also that the room she is in has many of my possessions in, and was understood at the time of her moving in that this was a spare room she was just going to use til she was on her feet.

Your options include:

 

First and foremost, check on your insurance coverage with your homeowners' insurance.

 

Have someone watch her.

 

Obtain a restraining order.

 

The thing is, you can't prosecute someone for thoughts.

It's not thoughts. She has made a declaration to other people in my house hold that she will destroy my property. How would a restraining order work if we are using combined living areas?

It would restraing her from destroying or stealing your property. It would be an added way to punish her later, if she violated it.

 

However, now that I understand more clearly what she threatened, since it's a definite threat you can file a police (or sheriff) report stating that she has threatened you. If the other people in the house cooperate with statements, that will help.

 

Still, however, the best thing to do is to keep an eye on her. And try to find her a new place to live.

 

One other option - work with your local mental health folks. If this woman is making threats, it's possible that they will pick her up and take her off your hands for a few days for observation.
