Not an Intellectual Property Law Question?
Question
I would like to know where I stand in regards XX XXX following matter. I lent a saddle (roping) with all the accessories to friends to use until they got a saddle for their horse or I needed it back. Well I finally decided that I needed it back and called them. They would never return the calls and finally I got ahold of them when I left a message that I was just coming over to get it (they are about 45 mins from my home). This is almost 4 years that they had the saddle and they sold it! To replace the saddle and all will cost well over 1200.00 now. Can I persue this matter legally or just to bad vor me.
Thanks

Hi I guess this is not an intellectual property law question, guess mostly a small claims court issue. All I need to know is if it is in my best interest to persue it.

Answer
well you are certaintly within your rights to seek the return of your property or equivalent compensaiton to replace it. As long as it was clear that it was a loan and not a gift etc. then their actions are unjustified and illegal. If they are not willing to compensate you through informal actions (e.g. letters, phone calls) then you could file a small claims suit, and you probably should because this is not a trivial amount of money and they apparently have not acted in good faith. You should seek the value of replacing the saddle, as well as fees incurred in trying to get it back etc. Before filing suit, you could write a letter that threatens legal action if you are not reimbursed by a specified time....that could work, and prefereably have that letter written by an attorney (which should be very easy and quick) or at least reviewed by one. best of luck
