Question

do I as a consumer have the right to be given a fair chance to repay a judgment if the company I dealt with has gone out of business and didn't set up repayment with the court before doing so. Do I have the right to be notified they are doing business under another name in order to repay them? I consider 90 days a considerate amount of time but 8 years later there's lots and lots of interest, do they have the right to not give me a chance to repay

Optional Information

Already Tried:
Offering payments, settlement, I tried to find financing but no one wants to pay off over $43 thousand in interest. I have asked the interest for the years they neglected to notify me of their existance be forgiven. I feel if they had notified us in a timely fashion we would not have all the excessive interest it is more than 4 times the original contract amount. We were given an opportunity to repay this judgment because this company sat on the judgment we think to ruin us, because we called the television station here exposing them for the bad work they were doing, and for renigging on a Title 2 FHA loan there by trying to force us into a conventional loan.

Answer

Hello,

My name is Eli and I am a JA attorney. I'll be helping you with your matter.

After a judgment, the company does not have to legally give you a time to pay. If they want to garnish wages, they DO have to serve you with a motion so you know it would happen and can ask the Court to stop, but in general, they don't HAVE to work with you.

It's not fair, but it's our current system.

Best of luck in your matter! I'm here if you need any more clarification or follow up info.

I hope you found my answer helpful, and if so please click on the GREEN ACCEPT button for my answer. This is the only way for me to get credit for my work.

Your question will not close, and you will still have the opportunity to follow-up if and I would be happy to answer any and all of the follow up questions.

Remember, sometimes the law under which your situation falls does not give you the outcome or the choices you wanted - please understand that this is not the attorney's fault, but the way of circumstance.

There might be a delay between your follow up questions and my answers because I may be helping other clients or taking a break.

Leaving a bonus and positive feedback is not required, but doing so is certainly appreciated!

You can always request me for a future legal consultation through my profile at http://www.justanswer.com/profile.aspx?PF=7286322&FID=7 If you do this, make sure to being the question with “This Question is for Eli…”
