Question

My grandson had a Gardian ad Litum for a quick custdy deal. Does he continue to have that same Gardian ad Litum for his whole childhood, even though nothing legally has happened yet with getting him away from his mother who is now on drugs? do I call her to get started on some kind of procedure to investigate the situation?

Not a thing. Im just now trying to figure out how to handle this. His mother is unfit, and his father, my son, is a better option, but hes on methadone, getting his life together, but just lost another job due to anger management. He takes care of his new son well and is doing a great job other than needing angermanagement and something for mild bipolar. But the mother is making drugs and doing them, and has seriou mental health issues as well. and dragging my grandson to a seventh place to stay in the past 2 yrs. with guy after guy, doing meth,heroin,etc. how should I proceed. with the Gardian Ad Litum, if still assigned to him?

A guardian ad litem is only appointed to represent a party for a single action (in this case, the custody issue), and are generally appointed by the court. Therefore, they would not be able to assist you in this matter.

 

I would suggest you contact Children and Family Services to see if they can offer any assistance to you with respect to your grandson. If they cannot offer you any assistance, then you may wish to consult with a local family law attorney regarding getting temporary guardianship of your grandson, at least until such time that your son or the girlfriend is in a better position to care for him. If you were appointed as his guardian, he could come live with you and you would be responsible for making all legal decisions concerning his welfare.

 

Guardianships can be very expensive, very complicated matters, so you would definately need the advice of an attorney before proceeding with such.
