My daughter lives in a rental property I own and there is also an additional tennant. The property sold at auction on Tuesday. I was told the renters in the home would have 90 days to vacate after auction or foreclosure. What is the real answer? The purchaser tells me that because they are related to the owner they only have 3 days.

Hi XXXXXXX,
The new law that you are referring to (Helping Families Save Their Homes Act of 2009) specifically states that the new owner must give "bona fide" tenants 90 days to vacate.
This means the 90 days is counted from the actual sale or auction, because that is when the new owner becomes the new owner.
It does not matter that you are related to the tenant, as long as that she is a legitimate tenant. Her paying rent will help prove that she is a legitimate tenant.
