How do I assist my mother-in-law with establishing a "estate(?) trust"? How can we shield the limited financial resources my mother-in-law has accumulated from being absorbed by medical expenses upon she afflicted with health problems?

<p>What you will need to do is transfer your mother-in-law's assets to someone else and then wait five years for Medicaid not to consider or "count" the transfer. There are several ways to go about this.</p><p> </p><p>If your mother-in-law is still cogent, she can agree. Otherwise, you'll have to use your power of attorney, if you have one, or obtain guardianship (conservatorship) first, to gain control of her assets.</p><p> </p><p>If it were me, I would consult with a certified elder law attorney, since this is a tricky area and they are the experts. You can find such attorneys here: <a href="http://www.naela.org/">www.naela.org</a></p><p> </p><p>Transferring assets to many types of trusts - particularly revocable trusts - will not accomplish your goal. If you insist on wanting a trust, will have to be a type of non-revocable, or special needs trust.</p><p> </p><p>May I be of further assistance? </p>
