Question

I was fired from my job today. I was a head teacher in a preschool. I had two assistants one of our children got out of the building. One assistnat said she was putting the cots away, one was talking to a parent I was watching the child who escaped. He had been trying to get out of the room all day, I left his side for a minute than had to take achild to the bathroom, apparently the escapee left in a group of children and parents. He was unnoticed by my class staff but seen by a teacher from another room. When called I went after him another teacher found him out side. Two days later my staff and I were sent home pending an investigation. Eight days later I was fired they were not. I could see if all were fired but I was the only one the scapegoat. I feel this was unfair. I spent eight days in limbo, and had been told we were a team, yet I am the one fired. It was unfair. Unfortunately, almost all employees are employees at will and can be fired for any reason or no reason. Unless you are part of a union, the law offers very little protection for people who are unfairly fired unless the firing was a result of discrimination (race, color, creed, sex, physical handicap) or sexual harassment.

You should apply for unemployment benefits and if you are turned down initially, you should take it to a hearing infront of a hearing officer -- you can state at the hearing that the assistants were even more responsible for the whereabouts of the children than you are as you have duties to actually teach the students their lessons and keep track of them, etc. etc.

I am sorry I could not tell you what you wanted to hear, but I simply interpret the laws as they are, not as we would like them to be.

Thank you for your quick response. My follow up question is are they liable{right term?} for the expreme stress they put me under. It is known that I have high blood pressure and diabetes. Also is there any possibility the CT Labor dept will help?

Not likely on either, I am sorry. Because they can fire you for any reason, it doesn't matter what your medical conditions are unless you can prove that they fired you because of those medical conditions. Everyone who is terminated is under stress -- and if they had to use that as a consideration in terminating you, then they would never do so. The CT department of Labor will likely tell you the same thing I am telling you. I am sorry, I really do not mean to sound so callous and unfeeling about this -- I do feel badly that you lost your job because your back wasn't being covered by your assistants and one little creepy kid (who is probably ill mannered anyway) got out of the room.

Your best bet is to try for the unemployment and that will at least tide you over until you can find another position.
