I am not very good with credit card laws. I am 65 yrs old and my husband passed away in 2002. I had tried to pay off my husbands credit card with Capital One. But as I was disabled I started to run into trouble. In May of 2005 I started to get behind, In 2005 I was hospitalized 5 times because of my heart. I had no money extra to pay this bill. In Feb of 2006 I had triple bypass surgery. January 2006 was the last statement I recieved. The bill in April was $679.70, but with late fee of $29.00 and interest by the Mar 2006 statement the balance was $1029.49. That was the last statement I received. Two months ago I received a letter from attorneys who said in March there was a charge off and they were now handling this and the balance is now $1837.71.I called them and was told they could take $200.00 off but I would have to pay the rest. My question is thi right?
You are not responsible for his debts personally. You would only be liable of you agreed to assume them in writing or were on the account or were a guarantor.
I had my own account but I was also on his account.
You are entitled to proof of debt so you can see what is owed and how payments have been credited. Now tell me when was the last time a payment was made or charge incurred on the account/debt?

the last time payment was made was April of 2005. I don't rember ever using the card after he passed away.
I am trying to see if you have a statute of limitations defense here that could stop them from collecting altogether. What state are you in since the rule depends on the state.
