Dear lawyer
My daughter birthday is XXXXXXX 2002. She ran away from home and high school classes and lived with her boyfriend who is 23 years old. Could i sue this guy? how many percentage to win this case if i have a police report for missing case and couple of pictures to capture this guy drive my child in a car when she's missing. i known her boyfriend address, but i can't get her home. Thanks

Exactly how old is your daughter and what state is this happening in?

Your question states your daughter's birthday is XXX 2002 -- that would make her 7 years old? I don't think that's right?

If she were 16 years old or younger you could have had him arrested and charges with statutory rape (sex with an underage person). Unfortunately, she is 17 now so that law no longer applies.

You can attempt to sue him, but you would find it hard to find a lawyer to take the case because the age between 17 and 18 is a very gray area and courts are not very sympathetic to such lawsuits when the "child" is almost of the legal age of 18 unless that child is mentally deficient or something like that. Your only hope is that the department of children's services might get involved because she IS under 18 and is probably missing school, and she is legally your responsibility until she graduates from high school.
