Question

I am also 2 years behind in taxes for my part time small business, although I have paid partial amounts to the IRS. I need expert help getting my taxes prepared and filed and I need help in dealing with the IRS. I live in Chicago. Who can you recommend that can help with both issues?

I guess I've been in denial and haven't really been dealing with it. When I last talked to the IRS (beginning of this year,) they said they could set up a payment plan for me, but only AFTER I became current with this year's taxes. It's been hard to do so, as many of my clients also have financial difficulties, so I was unable to get current. However, I do not want to go to jail!!

What are BOTH issues.

You only talk about being behind in filing your business taxes? What is the other issue?

Also, what type of business do you have? Sole proprietorship, LLC, S Corp, partnership?

Oh, there really isn't a "both". I neglected to delete that word from another post. However, that said, I haven't filed my personal taxes from 2007 either, though, since I haven't filed/paid my business taxes.

This is pathetic, but I'm not sure. I think it was an S Corp, which has been dissolved since I didn't do the annual report, etc.

I'm a psychiatrist who only works part-time, but am HORRIBLE with paper work and have a toddler at home.

Thank you for the clarification.

First of all, try not to worry about this resulting in you going to jail. That is not likely to happen unless you owe thousands and thousands of dollars to the IRS or have filed totally fraudulent returns. The IRS has had a long standing practice of not prosecuting taxpayers who show a willingness to straighten out their tax obligations.

Now as far as your current situation, if you owe taxes to the IRS for prior years and you also need to file personal and business taxes for the last couple of years, my advice to you would be to seek the help of an Enrolled Agent.

An Enrolled Agent is not actually a tax attorney, but they are licensed by the IRS to represent taxpayers in all matters concerning their tax bills, and they are very knowledgeable in all aspects of the tax laws. An EA would be able to help you with your negotiations and with the filing of your returns. An EA would also be much more affordable than using a tax attorney, but at the same time could offer you much more tax guidance than simply using a tax preparer to prepare your returns. And you really should stay away from the firms that advertise they can settle your tax debt for pennies on the dollar, because in 99% of the cases that is just a waste of your time and money.

I would suggest finding one or two EA's in your area, and giving them a call to discuss your situation. They will then be able to give you an idea of what services they can offer to help you.

Hello again srh,

An enrolled agent takes a special exam administered by the IRS to test his knowledge of tax laws. If he passes the exam he is issued a license to represent taxpayers in tax court, the same as a tax attorney.

CPA's are accountants licensed by the states. Not all CPA's are experienced in tax issues.
