Hello gpa,

The only possible way to get a copy of a W-2 form from 1998 is through the employer you worked for at that time.

The IRS by law is required to destroy tax records that are older than 10 years old, so they would no longer have any copies of your W-2 forms from 1998.

If you simply need to know how much you earned for that year, you could get that informatin from the Social Security Administration, but they would not have an actual copy of your W-2 form.

the state of Louisiana is telling me that I owe them estimated taxes of 1500 and penalties and interest of 1200 for tax year 1998, I called my former employer and they said that they could not help me. what are my options

If the state of LA is just now auditing your tax records from 1998 and they have figured that you owe more tax that what was originally paid, then the state of LA must still have copies of your tax records for that year. States are not under the same legal obligation as the IRS as far as how long they keep tax records on file.

That being the case, you should be able to simply request that the state of LA send you a copy of the tax information they have on file for you for 1998. When your W-2 forms are issued, copies of that same form go to both the IRS and to the state, so the state of LA either still has an actual copy of your W-2 form, or they will at least have a computerized report of what was on that W-2 form. That will be the only way you can verify this information.

The Louisiana tax dept is saying that I did not file a state tax return that year but thr IRS says that my federal return stated that my address was based in Louisiana. They cannot provide me with the address and since a moved often with my former employeer I am not certain if I lived there or not at that time. It seems that the burden of proof is on me but no one can help how can I fight this matter?

Actually, having your W-2 form in this case would not be of any help in proving where you lived. Apparently when you filed your federal return for 1998, you must have used an address in LA on your Form 1040 that you filed with the IRS. Your W-2 form may have shown a completely different address if you moved during that year.

If you did not actually live in LA during 1998, you are correct that the burden of proof would be on you to prove. The only thing you might try is to research property tax records if you owned a home there, or contact apartments where you may have lived during that time period.

I assume that you did actually live in LA at some time. When you moved, where did you move to? And do you even have an approximate time line of when this happened?
