Question

I am in the process of having my medical records transfered to a new doctor. I filled out a request form and the new office sent it to my old doc giving them my permission to transfer my records. I received a letter from my old doc's office requesting that any outstanding bill be paid before they transfer the records. I expected this and find it to be reasonable. They are also asking for an $8.00 mailing fee. I find this reasonable as well. However, they have requested $79.25 for a "copy fee" for 267 pages.   Is this normal? I can understand a flat handling fee. I wouldn't be upset at something like $25.00 or so. However, we are also requesting records for my husband, whose chart is probably as big as mine if not bigger. (we've not received a bill for this yet.) Is it legal for a doctor to charge in this way? To me it seems that they are punishing us for finding a new doctor.   We live in Indiana

Optional Information

State/Country relating to Question: Indiana

Already Tried:
I just received the "bill" today. The doctor is only in until noon on Friday, so they were already out of the office by the time I got home from work. There was a message on my machine to call the office on Monday, but I would like to know beforehand if this is legal.

Accepted Answer

Unfortunately state law permits this and has the following limits:
    • $20 labor fee (includes first 10 pages)
    • $0.50 per page (pages 11 through 50)
    • $0.25 per page (pages 51 and higher)
    • Actual mailing costs
    • $10 rush fee if records are to be provided within two business days
    • $20 certifying fee (if certified)
