Dear Friend,
Sorry for your situation.
Coming straight to your problem, NO...Your husband's pension CANNOT BE GARNISHED.
He has no "Leagl Involvement" on the Credit Card and business you owned. Also no involvement in the debts your owe.
Remaining very to-the-point, I would seriously suggest you to kindly so not waste any time on this. What you can do is that when you appear in the Court tomorrow, you please submit a written submission and state the FACTS to the Court. You seek a legal advice tomorrow or at the earliest, and file for a STAY on the garnishment. YOU CAN DO SO...
Secondly, you can contact the Bar council of your State at http://www.michbar.org/generalinfo/staff.cfm which will assist you to find an attorney who has experience handling such matters.
TO SUM UP, you WILL have to put up a fight and do this you can do either by your self or engage an attorney to appear, submit a written reply and also file for a STAY on garnishment...THisis something you will have to do immediately..
I hope the above helps...
Regards,

WHAT IS A WRITTEN SUBMISSION IS IT JUST A LETTER FROM ME OR IS THER A SPICIFIC FORM TO BE FILLED OUT? HOW DO I GO ABOUT FILING A STAY ON GARNISHMENT IS THERE A SPICIFIC FORM THAT NEEDS FILLED?
THANK YOU VERY MUCH
JACKIE DOW
Dear Jackie,
You can give a simple written submission. The clerk of court will help you if you do not have a lawyer.
To fiel for a stay, I request you to take a professional help of a attorney as this is a specialized job. I told you WHAT can be done and WHAT IS to be done. BUT you will certainly need a lawyer to do this for you.
