Question

My neighbor is putting up a fence to protect his grape vinyard. He is not sure where are property line is as he didn't want to do a boundry survey due to the cost. He is now putting up the fence. It is close to where I feel the property line is. Before the fence came along there were tall weeds growing between my property and his. What I want to know is do I have the right to cut down all the weeds on my side of the fence once the fence is put up? I feel with him putting it up and not knowing the boundries for sure that once the fence is up it is his way of saying that all the land on my side of the fence is mine to do as I please. Am I correct to think that?

My neighbor tried measuring everything off after I showed him my property layout from the surveyor when I bought the house. I checked with the Register of Deeds there is no boundry survey on file for this property. After we first talked about it 2 days ago he never talked to me again. Today his people were installing fence posts so I am under the impression he feels what he is doing is on his property. I am just interested on my side of the fence.

Thank you for your question, XXXXXXXX; I never assume anyting, especially when it has something to do with what someone else is doing. He cannot install the fence directly on the boundary line; fences must be installed completely on the property of the owner of the fence.

 

The only way to determine the correct property line is to bring in a surveyor. Although a cost is involved, it would be costlier if your neighbor was taking part of your property. Since he does not have a survey of his property either, do not assume that he knows what he is doing or knows for a fact that h is installing the fense totally on his property.

 

You can cut down the weeds even if you ultimately find out that they're on his property because of health safety; weeds attract mosquitos and a place where many outside animals hide.
