I'm writing you to see if you may be able to help me or direct me in a good way. I running scared and need to know the best way to go about this. I do not want to loose my home the servicer(Ocwen) is refusing payments and caused me to now be 3 months behind. My belief is I applied for the modification and they were suppose to give me an answer by the end of August and now they're trying to make me look bad by not allowing me to make payments. I have tried and they reject my calls and even blocked payments online. THIS CANNOT BE LEGAL. Can you please advise me or be an advocate for me I heard that they were one of the banks who took the bail-out shouldn't they help those in need. and not reject their calls to cause them to go into default and cause them bad fortune.
I do believe it's time for someone higher up to step in for the people before it's to late.
If you go on the internet and look up Ocwen you will see the illegal behavior they practice and on the BBB their rating is an F.

Hello Diane: First, we cannot provide actual legal reprentation to people or recommend lawyers. That said, I know Ocwen has a reputation for being very nasty to deal with collections-wise. On the other hand, Ocwen was featured in a National Public Radio story last May as being one of the leaders in quickly working out "fixes" with borrowers (mostly sub-prime) who were in trouble. So take your pick. It sounds to me like you aren't far enough in default to get your situation out of the collection department and into the loss mitigation or home retention department at Ocwen. I know this sounds crazy, but I think you'll get better treatment from them when you are 4 or 5 months behind than you got when you were only one or two months down. So stop sending payments for a few more months, but save the money aside and have it ready to use in either a repay or loan mod program. Sooner or later, your file should end up on the desk of the person who can work out a deal with you. Also, how they treat you might depend on wheter you are sub-prime, conventional insured, FHA/VA etc...
