Question

Hi,

my dad (us citizen) filed an I130 petition for my brother who is over 21. The petition was approved by USCIS, however, in the meanwhile my brother got married. I was wondering what the process would be, now? Should they just call USCIS and notify them to update the category? I think he would be changed from F2 to F3 category, is that correct? Would his application still remain approved or would that one be voided?

Answer

Your brother is changed to F3 as a result of the marriage, correct. Has your father received notification that the file is now with the NVC? If so, it is best to communicate with them via email, putting the NVC case number in the subject line. They will make the change in category, no new petition is required to be filed.

No, he has only received the notice of action that the case was approved from the USCIS. How should he approach them? Does he have to send any information from the marriage itself, like marriage certificate?

Then he sould write to the Service Center and requst that they do a Change of Category. It would be wise to include a copy of the marriage cert (and translation if it is not in English).

However, it is also advisable that once notification is received from the NVC that this information is often communicated to them because once CIS approves a case, they don't change the category generally, they leave that for the NVC.

Last follow-up question.....

Since the application is approved by the USCIS and forwarded, but not processed, yet by the NVC, does this void his original approval by the USCIS? What I mean, is his application now switched to the F3 category and re-processed by the USCIS? I think processing times by the USCIS for the F3 category are longer.

Or is he fortunate and the application is just from now on processed as a different visa category without any influence on processing times?Thx

His petition is approved, no further processing, they just change the category.
