Question

i am a legal american citizen and my finance lives in musat, oman. i live on social security disability and therefore live on a fixed income. i wish to obtain a visa for my fiance to move to the United States. I live in the state of Montana where marriage by proxy is legal. the problem i have is financial difficulty. I am an american muslim and my fiance is also muslim. He too has financial difficulty. is marriage by proxy available to us to speed up the process of getting married without having to go through the the K-1 129F form process in order to obtain visa for him to come to the United States? it will cost 455 dollars to process the K-1 finance visa form for eligibility to obtain form 129F alien fiance visa. i cannot afford this right now and the process will take too long. i was wondering if marriage by proxy is a viable alternative to this process. Thank you for your time and consideration. P.S. i am not a member of the armed forces.

No, marriage by proxy is not recognized by the US immigration laws.

If you have a problem with finances, you are going to have to also find a joint sponsor who is willing to sign an affidavit of support for your husband when he applies for his immigrant visa if he got here as your fiance.

The joint sponsor would be liable to the US government for any means tested benefits that your husband may collect for 10 years after becoming a permanent resident. The federal government would have the right to sue them for the reimbursement if the could not collect it any other way.

You need to plan this out all the way because your SSI is not counted as earned income for purposes of the I-864. There has to be a long term plan because if he comes here and then you cannot help him get his legal residency, then he would be in a bad situation.
