Question

my wife is being harassed by an old high school acquitance. I confronted last year and got in writing that he would stop.. seeing her, one year later he starts calling her again.
I also called his wife adn told her last year. can I take him or the company he is working for to court ??
He has bassically brought my family and relationship with my wife to brink of collapse.

Already Tried:
Told the guy to leave my wife and family alone and focus on his family. He is married, 3 kids, catholic church goer..
Confronted him by phone several times, we live in Georgia.
I also have records of emails he exchanged with my wife last year when they were having the affair.. he took advantage of my wife that was going through a difficult period. Their affair lasted from Feb -Aug 08, my wife agreed to stop seeing him..end Aug 08.. He wrote me a latter stating he was sorry for the harm he had imposed on my family.. One year later he starts calling back.. Do I have any legal gounds to stand on. Can I go after his employer as he has been exchanging emails with my wife using his comapny email. I want to take the guy down

Ok, if he continues to contact her, she can file for a restraining order that will order him not to have any contact with her or he will be arrested, even out of state.

 

Under Georgia law:

 

Restraining orders are issued in the Superior Court and is an order which restrains, or prohibits, certain conduct on the part of an individual. A criminal case need not be prosecuted in order to obtain a restraining order.

 

Violations of restraining or protective orders.

Should a party violate either a restraining order or protective order, the Superior Court has jurisdiction to deal with that violation. In certain situations, the appropriate law enforcement agency will arrest the offender for violating the terms of the order.

Ok thanks, but what about firm he works for, can I go after them as he is using their email, company time.. telephone to harass my wife.. If I write them with a formal harassement complaint, will this force them to take action and fire the guy ?? can we claim damages from his Company and or himself..

I don't think that his employer would have any liability since they are likely unaware of his actions and there is nothing that legally prevents him from contacting her now. Once a RO is in effect, even if you notify them, they have no duty to you and, since they are not a law enforcement agency, (I assume), they are not obligated to enforce the law.

 

There is nothing to stop your wife from suing him civilly for harassment. It might be hard to collect with him being in another state though.
