Can I appeal a building code restriction on the height of my fence in a side yard

You certainly can !!! Although to be successful you will need to do a little "homework." First step would be to have some neighbors, that can see the fence, sign an affidavit that they have no problem with the height. Second step would be to drive your neighborhood, at least a 10 block square, and check for any other fence of any type that is as high or higher than yours. Third step is to draw, to scale, your lot with the house footprint on the lot. Show the location of the fence and the length to scale.
