Question

My dad quit claimed his home to me, his only child, when my mother died, and retained a life estate.   He remarried, but has since passed away. Does his wife have the right to remain living in the home? The status is still the same, no changes were made to the deed.

Local inquiry to attorney said step-mother had right to live in house, even though it now belongs to me. I had no right to sell, charge rent, live in the home, or ask her to move out. Is this correct, according to Mississippi State law? What are my rights as the owner?

Accepted Answer

NO. This was a lifetime transfer. The child owns it subject to the life estate that ended on the death.    The wife needs to leave and if refuses, can be evicted by eviction court action.
