Question

We have just had our carpet replaced with solid oak. We supplied the wood for a “precision carpenter” to put it down. We had asphalt put down first as he said that this was ideal to lay the wood on.
We immediately complained that the floor was creaky and unlevel. After numerous promises to rectify the matter and not turning up, we got advice form other contractors, who stated the wood had been laid on an uneven surface and that a levelling compound should have been used.
We put this in writing to him and again he stated that he would come and sort it out. Now he is saying that it was not his job to check the floor was level before starting the work and he is not willing to rectify this.

Where do we stand?
Was it his job?

Hi XXXXXXX
The creaking could be caused by loose sub-floor boards (which should have been screwed down prior to the installation of the oak). It could also be caused by inadequate nailing when the oak was installed as well as from having been laid on an uneven floor. There is no question that it is the responsibility of the installer to properly prepare the surface before installing new flooring which would have included leveling the sub floor if necessary. Your installer is reluctant to return because the only proper way to rectify this problem is to rip out the oak and start over.
As far as where you stand, that is a legal question which I can't answer for you. In addition to this question you should post a question in the legal category (UK legal if you are in the UK)
