Question

Hi.

My annual salary overseas as US expat $180000.00 tax free. The job offer is permanent. I am married with three kids. How much approximate tax I will owe to IRS annually?

Thank you for using justanswer. I'm not sure exactly what you mean when you state that your salary will be tax free, unless you mean its tax free in the country you earn it. Normally, US citizens are requried to report, and pay tax on, world wide income. You may exclude up to $87,600 (2008 figure, 2009 figure is not available yet) by filing Form 2555Foreign Earned Income exclusion. with your Federal 1040 tax return. The remainder of your salary would be taxed at your normal graduated tax rate the same as it has always been in the past.

You mentioned filing your return as an Expatriot. Filing as an Expatriot means that you are giving up your US citizenship. If that is the case, you would need to file Form 8854Expatriation Information Statement.

If it is your intent to give up your US citizenship, filing Form 8854 can be quite complicated, so you may want to have a tax professional help guide you thru this form as you must list your actual US tax liability for the last 5 years along with any assets you still hold and any you sold prior to leaving the country.

Please be sure to read the instructions for Form 8854 (linked below) especially for lines 8 & 9 that deal with any time you may be present in the US after you have declared yourself an expatriot.

Thanks Anne for your reply. I need few clarifications.

I have no intention to give up my US citizenship. It's like US citizen working abroad. Yes, the country I have offer does not charge any taxes. The offer is permanent and i can work in that country as long as I want and come back home US.

Will that just be filing form 2555? And what i need is approximate ballpark amount that how much taxes I would pay to IRS federal, social and medicare on $180K? Again I am married and three kids and all are dependnets.

Are you being paid as an employee where they will withhold your taxes, or you are you going to be considered self employed?

I will be paid as employee of that company. No withholding of taxes as that country in question don't charge taxes to people.

It's not US based company, it's a foriegn company.

Since there will be no Federal tax withheld, you are, for US tax purposes, treated as being self employed, so you will not only have Federal taxes you must pay on the money, but also your Social Security tax. (Sometimes referred to as Self Employment or SE tax)

Since I have no way of knowing whether or not you could itemize deductions, I will use the standard deduction for 'Married Filing Jointly" for this scenario. For your Federal tax liability, your calculations should look something like this:

$180,000
- $ 91,400 Foreign income Exclusion
- $ 11,400 Standard Deduction for "Married filing Jointly"
- $ 18,250 Personal Exemption Allowance $3650 ea for 5 people

$ 58,950

You Federal tax liability on $58,950 taxable income would be $10513. Please see below for tax rate schedules:

However, even though you may exclude up to $91,400 in foreign income, if this is considered self employment income, then you must pay your SE tax on the whole amount. SE tax is figured at 15.3%, so on $180,000 you SE tax liability would be $27,540.
