Question

I think I need a lawyer - I have been in a debt settlement program for 2-3 years now through Able Debt Settlement. I thought I was making progress and I pay all of my regular bills just fine. Just got a letter that one creditor is trying to garnish my wages - has sent a letter to my employer. ADSI sent a letter in reply but I don't really understand what's going on or how to stop it.   I am a teacher, definitely do not have any extra money as is. How can I stop this? Do I need to file for bankruptcy?How do I find a good inexpensive lawyer?

I have been working with a debt settlement agency for several years - thought I was making progress. I was supposed to be saving money to pay eventually but then my boyfriend at the time was out of work for months and we used all that. I now have no savings and am living basically paycheck to paycheck but get all of my regular bills paid. Still have one open credit card for like $1200 that I am trying to pay down. I did not return phone calls from the other lawyer (Frederick J Hanna)after a point because the people were just threatening and I told them that no, I did not have $6000 sitting around to settle or I would have still been paying in the first place. Then they were just rude & scary.

Hello,

 

Your state was not available on my first screen.

 

In order to garnish your wages, the creditor must first file suit against you and prevail. Until judgment is entered the creditor cannot garnish your wages.

 

You can consider filing a bankruptcy if your wages are actually garnished. However, since you have been paying your debts down, you may want to wait and see if a judgment is actually entered.
