Question

In a strip mall parking area in california is it legal to park a large pickup truck 2 feet out of a parking space in a narrow parking area basically having the tail of the vehicle in the driving area leading to a fender bender. Is there any liability towards the person who parked negligently?

It is not proper to park in the manner you have described, but as far as liability, it is the liability of persons driving in the lot to be aware of and avoid those types of hazards. Even if there was some liability on the owner of the truck under contributory negligence it would likely be less than 20% and thus you would not have grounds to recover from them.

I am not looking for any recovery on my part...matter of fact I am not claiming any repairs to my vehicle. I understand it was my fault in hitting the vehicle but, what is upsetting is after talking to the other person's insurance company they emphatically place all blame on me. I am more concerned about my insurance ramification due to an accident that is stated as completely my fault. Is there any legal recourse I can take to mitigate my blame or at the very least state on the record that the other side is partial to blame? I do have photos of the incident and the manner at which the other driver parked their vehicle.

I understand and you could as I say, argue contributory negligence if you had the information on the truck to make a claim, but at the most (and I was being generous) under contributory negligence his negligence would be no more than 20% or less and that would only reduce what you would have to pay insignificantly.
