Question

I helped my mother refinance her home within the past 36 mths. I never made any payments on the mortgage, but my name was on the mortgage and deed. Would my wife (who is also a first time home buyer) and I be eligible for the first time home buyers tax relief if we purchased a home this year.

Hello stooge,

As long as you and your wife did not actually live in that home with your mother, then you are still eligible to receive the first time home buyers credit.

Taxpayers who owned a property which was not used as their primary residence still qualify for this credit.

I have lived there. My wife never did. We got married last year. I helped my mother refinance in 2007, but at that time this was not my primary residence

Hello again stooge,

If at any time in the last 3 years you lived in that home as your primary residence, and your name was on the deed as a partial owner, then you would not be able to claim the tax credit.

And even though your wife did not live there and maybe did not own a primary home of her own, the law tests the ownership of both spouses. If either spouse has owned a primary home in the last 3 years, then they are not eligible for this credit.
