Question

My husband died in May in Arizona He worked for a company that owes him money. they are wanting his computer and documents. They have not proven the computer belongs to them. Can I be charged for not turning it over? Now that he has died they deny oweing him money. I have some documentation and conversation proving differ. He wouldn't have turned over the computer due to monies owed for his work. have witnesses that wil verify that they owed him money but have not located docs. he has not been paid since Aug.2008. They had 9 months to get it before he died suddenly.

I have met with them. They don't answer my questions in writing and are very evasive, by the way he is owed a percentage of properities sold. The company he worked for also owned the farm team for the Coyotes. New Mexican Scorpions. They might be sold on Sept 10th in Canada and I am sure they want all the documentation for this to happen in which my husband was the CFO for that team also. I sent out an email that reads below. there response is below this email.

In actuality my questions have not been answered several times and certainly not in writing.   
The documents and computer are the property of Rob’s estate and since I am the Personal Representative of this Estate without restriction, I have been advised legally not to relinquish any documents at this time.   I want to feel confident, I have fulfilled my duties to the estate with all the i’s dotted and t’s crossed. I could reassure you once I feel I have the necessary information and funds to have fulfilled my job and close out the estate dealings, I will be happy to assist you with whatever it is you might need. Another words I do want to work with you.
Until all financial issues are resolved and finalized that we discussed; I will not be able to relinquish any personal property or documents.    You will want to take some of the responsibility, that your requests are not able to be carried thru sooner than later.   
With or without documentation, I am open to resolving this issue with a mutual agreement,    compromising settling of funds owed to finalize Rob’s estate.

their response We will be passing this matter over to our attorney to deal with – the computer is our property as our the data and the files. You are more than welcome to copy what you want we are not trying to prevent you from having this information rather we need it to finalize a number of outstanding items.

If they have not proved the computer belongs to them, there appears to be no reason to give them a computer that may have been the property of your late husband. If they file an action to recover the computer, you can counter that the computer belonged to your late husband and that money is owed to him.
