I filed taxes with my ex husband even though we were separated and IRS sent a letter of deficiency. I appealed since I did not benefit of his earnings that year and now want to do Tax Court because the appeals officer denied relief of the 56,000 because I did not establish a belief that he would pay the tax. I have to send a statement to Tax court but not sure how I can show a belief that he would pay the tax. He wants me to not be involved in this and has assumed responsibility. He will take care of it with a payment plan with a revenue officer. I have to mail this statement/application this week. Any help will be appreciated.
