In April of 2009, I paid $450.00 for an appraisal on my home, referred to me by First Ohio Banc and Lending, Inc. Old House New House, Marcus Dockery, specifically did the appraisal of which I've never seen. After all the paperwork had been submitted and the appraisal was finalized, Jeff Names, a representative of First Ohio, called me to say that the loan would not go through because there were a number of homes in the area in foreclosure. He also said that he would provide me with the contact in order to receive a refund. He provided me with the name of a company who does not service Upper Marlboro, MD. I called Jeff back and he then said he would get back to me. I didn't hear back from him from April to June/July when I called him to ask what had happened. He said you never received the refund? I responded, "No". He then said he would call me back and he has not had the decency to return my phone call. Is there anything I can do to get my money returned?

Answer

Yes, first you should send Jeff a certified demand letter requesting the refund. In the letter you would cite the previous phone calls and his response that you should have received a refund. In the letter, give him 15 days to issue a refund, and note that if he does not comply you will file suit in small claims court.
