Question

My employer is Wal-Mart. They now have a program where they time how many boxes we stock an hour. On the grocery side we have to stock 60 and on the General Merchandise side we have to stock 35. We are told almost everyday that we will be held acountable for the times and if we are not most of us are facing termination. Most of us are not given the time to properly train. For example a new hire gets one month to get up to 60 case an hour in a specific area, but if someone who has been with the store for over a month and gets put somewhere new with no idea where anything goes will get coached if they do not get done in the time frame the first night they are there. This is the only shift being held acountable for productivity. The cashiers are calculated on how many items they scan an hour but not one other area or shift is held accountable for what they do. I am wondering if we have a case for discrimination and/or Harrassment

Unfortunately, as at will employees, you are at the employer's mercy here. Discrimination or harassment in the workplace MUST be based solely upon your age/race/sex/disability and nothing more. Therefore, if they are doing this to you based solely upon your age/race/sex/disability, then you have grounds to file a complaint for discrimination/harasment with the EEOC. Other than that I am afraid you will just have to work with management to make it more reasonable.

I am talking about shift discrimintation. Not individual. I am talking class action lawsuit. We could be discriminated against because of thje shif t we work is what i am saying so no you will not get my $15 dollars

There is no such thing as "shift discrimination" in the law, you are making up terms that have nothing to do with the law. You have no grounds to file a lawsuit. You came here and asked for a legal answer and it has been given to you. As an at will employee the employer can dictate the terms of your employment as I explained above. There is no such thing as "shift discrimination" in the courts and this behavior is legal.
