Question

My father died when I was 6 years old leaving a Will and a trust. The trust was left to my Grandfather for 10 years until it broke, then going to my mother as the trustee until I met the required age to inherit what was left in a trust. The will states I get it at the age of 21, however my mother say's I get my inhertiance at the age of 25. Is there anyway she can change the will even though she wasn't his wife when he died? Furthermore is there anyway I could of signed something when I was younger changing the conditions of when I inheriated the will? If so can that be disputed in a court of law?

Is there anyway she can change the will even though she wasn't his wife when he died?

 

Response 1: She cannot change the Will. The Will is the last testament of your father and not your mother's. Legally, your mother cannot change the terms of the Will. It is not her document to change. If your father's Will states that you will get your inheritance when you turn 21, that is when you are going to get it unless the Trust has different age when the Trust will be dissolved and turned over to you.

 

Furthermore is there anyway I could of signed something when I was younger changing the conditions of when I inheriated the will? If so can that be disputed in a court of law?

 

Response 2: No, you cannot sign documents to change the terms of your father's Will either. Your father put the conditions in the Will for a reason.
