<p>hi</p><p> </p><p>it would really help if you could provide the code you are specifically referring to - there are a few statutes that refer to the lead paint and who is responsible for abatement, etc. for instance under the NY Administrative Code when discussing daycare it states </p><p> </p><p>10. "Operator of such day care facility" shall mean any person who<br /> provides day care service and<u> the owner</u> of the premises where such day<br /> care   facility   is   located.   "Person" shall mean an individual,<br /> corporation,   partnership,   association   or   other   for-profit   or<br /> not-for-profit entity.</p><p> </p><p>so, if i had the exact law that you are referring to it would be very helpful in trying to determine how "owner" is defined. absent that, an "owner" is the person who holds title to a property, pays the property taxes - and "occupant" is a person who resides in or occupies the building.   and owner may also be an occupant; but an occupant is not necessarily an owner.</p><p> </p><p> </p>

New York State Sanitary Code, Title 10, Section 67-2 et seq.;

Public Health Law Section 1370 et seq.; and

Putnam County Sanitary Code, Article XII, Section 8.2

 

Is there a general definition in New York Property Law defining an owner? For example, is an owner defined as a person who holds the deed to the property, etc.

thank you for that information. this is the definition under Article I of the MRE portion of the NY Code

 

36. "Owner." Owner or owners of the freehold of the premises or lesser
estate therein, a mortgagee or vendee in possession, assignee of rents,
receiver, executor, trustee, lessee, agent, or any other person, firm or
corporation, directly or indirectly in control of a dwelling
