Here is my situation... I gave notice to my landlord that I would be vacating my rental property before 8/1 (rental house). He said that he needed to do a termite inspection the first week of July, and was concerned because I have an 80lb German Shepard. I told him that I would be on vacation from 6/26 to 7/12. While I was on vacation, he removed $30,413 worth of computer equipment and some personal items, such as a set of wood planes (for woodworking), and 2 prescriptions (he left one).

He states that he wants me to pay for the house to be prepared for the next tenant, for example painting all rooms, landscaping, hanging screens (which were never attached to the house as the mounting posts are not installed), hanging a screen door which fell off because the wood behind it was not presure treated, and rotted. In all, he wants me to pay him $3505 for prep work.

This occurred in Arkansas.

Police were called, Arkansas incident # 2009-79689.
He asked me to vacate the property by 7/19 and he would return my property, which I did. There was a cracked window, which I fixed, and a hole in a wall which my child made while playing, I fixed that as well. When we met on 7/20, he was supposed to bring my belongings, instead he handed me a list of things that he wanted me to pay for.

First, you need to file a complaint with the local police for the theft of your property. You may also want to contact the local housing authority regarding this extortion and the health department regarding the theft of your prescription medications.

 

Unless your lease provides that you are responsible for all of these items, the landlord is engaging in criminal extortion. You may also need to consult with a local property law attorney about sending a demand letter to the landlord for the immediate return of your property or a lawsuit will follow.

 

If the landlord is incorporated, you should also report them to the BBB and the state consumer protection agency.
