Question

May our 50th high school reunion committee use our cartoon image of the school mascot for our reunion decorations without violating copyright law? We do not plan to make any money at this event, nor has the image ever been used for any purpose besides high school events. We really don't know whether the image is copyrighted. It so, it was probably by a print shop or something at least 50 years ago. Thank you.

Optional Information

State/Country of Question: California

Already Tried:
Nothing - we could not image that such a benign practice could have any consequences whatsoever. Somebody brought it up, so we thought that we should ask.

Accepted Answer

I recommend you contact the school and ask them to sign a waiver on allowing you to use the image. Although you cannot be sure if it is copyrighted, if the school has the permission to use the image, they have the ability to extend that permission to you.

There is a low probability that anyone would wish to bring suit against you without taking the step I am recommending to you, but just in case it wouldn't hurt to insulate yourself against possible infringement.

Sincerely,

XXXXXXX XXXXXXXXX XXXXXX, Esq.
