Question

my daughter has an apartment in a government subsidised apartment building, lost her job, rent was not lowered immediately therefore she got alittle behind. $257.00. she was served with papers to go tocourt for past due monies. she went to court with money in hand only to find out that they were also doing eviction proceedings on her the same day, with no notice or knowledge to her at all. judge gave her 4 days to get informed because she did not understand the proceedings at all. short notice has left her with no knowledge and very confused as to enanwhere she will live with her 2 year old son once they evict her. she has been a good tenant and is very worried. Any advise I can pass on to her to help her when she goes back to court on the 19th? Thank You, XXXXXXXXX XXX (Grandma)

she went to court as told with her past due rent in hand. The legal assistant at the property managment office told her that if she came in with her money they would honor her tenancy. she went to court and they also start an eviction proceeding which she knew nothing about. the judge was not happy and continued it for 4 days so she could get some advice. nobody has been able to fit her into their schedule. she goes back to court o the 10th of july

If she has fallen behind on rent, the landlord has a right to cancel the lease, including if the rent is not made in full.

 

The decision on what to do rests with the lender. It can agree to reduce rent/modify rent and allow you to stay. Or it can proceed with the eviction. The choice is up to the landlord.
