I signed a contract with a company to get a modification on my mortgage in November 2008. They had a guaranteed money back offer and I felt secure.. I waited and at first they kept me up to date on their progress. After a while they stopped calling and only e-mailed me with updates. I began to get impatient and called them. They didn't give me any information and said they were still working on it. In March of 2009 I asked for more information. They kept asking me to send updates on my paperwork such as bank statements and such. By April I had enough and wrote a letter telling them that I wished to terminate my dealings with them, and that I wanted a refund. They no longer answered my e-mails, faxes, or phone calls. Then in June 2009 the President sent me an e-mail stating that he refused to give me a refund because I had breeched the contract by talking to my lending companies. I didn't contact anyone while under contract with them and I sent them proof of this.

I live in Maryland but the company is based in California. I have called them, faxed them, and e-mailed them. I filed a complaint with the BBB but they aren't registered with the BBB so there isn't anything they can do. I also filed a complaint with the Federal Trade Comm. FinCen, and also wrote to Goodhousekeeping to the rescue. No one seems to be able to help.

Thanks for your question. Youmay have small claims case here for any fees you lost here. You can certainly file pro se and seek judgement in the matter. I agree with you that they are jsut making excuses to keep your money in the matter.

I would also file complaints with the BBB here and your state attorney general consumer protection section. This costs nothing and they may get you restitution here as well. These would be your remedies.

I have no mercy for companies that practicve this kind of decpetion to consumers that need help like yourself. Please file the complaints here and consider small claims in your location as well. I wish you the best..

I went on line to the BBB of Md. and they said that I would have to file in the state that the company is in. I have already done that and if they are not a member of the BBB then there is nothing they can do. Also if I file a small claim on them it has to be done in the state of the defendent and that is California. I can't afford to go to California for a small claim trial and the owner of this company knows that. At this point it looks like he has won and I just lost $3100.00 to him.

I already reported them to the FTC and they couldn't help me. I probably will try the AG office, but haven't gotten that far yet. I have been trying to stay in touch with these people but I'm afraid if they feel threatened they will change names again as they have in the past, then it will take me even more time to try and find them again.
