Question

Me and my domestic partner has decided to separate after 6 yrs. We bought a house together however since I had a house at the time, couldn't finance and get my name on the mortgage. We have a joint account for all of the mortgage and bills and have shared all this time. It has always been agreed if there was ever a split, the house would be sold and the equity split...now she is saying I need and attorney, she doen't know if she is going to give my my part of the equity. What can I do? Help?

Accepted Answer

You will have to get an attorney to help protect your rights to the equity if she is not going to honor your agreement. Without sueing her you can not force anything if your name is not on the deed to the house.

Answer

A family law attorney would be were you should try first since this is very similar to a divorce situation. But if you can not find one then a civil attorney who handles contract issues, since you had a verbal contract to share the equity in the house.
