im on terminal leave from the army. my husband tells me he wants a divorce i told thats fine so ive made plans to move back home. now aug.4 im out of the army ill have no job i know im entitled to my husbands bah. my husband is trying to black mail me basicly by saying if i take my portion of bah which im entitled to by military law that he is going to "turn me in" for something that happened 1 and a half years ago. i was drunk through something at him and busted open his lip i was drunk that night and proceeded to atempted to kill myself the i wasnt in my right mind anyway the next day i checked into a mental hospitial and stayed there for 2 weeks and got the help i needed. so my husband likes to say when we get into arguments that i beat him and he is going to turn me in for something that happened a long time ago and he never reported it. besides that time ive never thrown anything at him or hit him. i had a very bad night 1 and a half years ago regreted it and he has been hanging

can my husband press domestic violence charges against me for something that happened such a long time ago and was never reported? also does my going into the hosiptial the night after it happened work for me or against me?

No, it appears that the one year statute of limitations on misdemeanor charges in Virginia would apply, and he would not be able to press charges against you. Additionally, the only evidence of this would be his testimony and perhaps any medical bills he may have sustained.

 

Your mental state at the time of the incident would be relevant, but in this case, it doesn't matter since the statute of limitations has expired for the crime.
