Question

She threatens me, telling me that the next step is to call my local police. Now maybe it is naive on my part... But I doubt that the police will arrest me for a crazy internet stalker, who demands that I remove a picture of me AND her daughter that was posted in 2006. It also has positive comments on it from her. She is claiming that I "stole a picture if her underage daughter". She can't even see that it's up. It's not viewable to anyone but my friends. I love this picture, and I love the little girl. Do I possibly have grounds for a no contact order? I have been blocking every way she found, but she keeps hacking in as other people, and not respecting that I asked her to not contact me. She harasses me through other parties, and takes advantage of my dhaky relationship with my parents by starting false rumors and exaggerating old issues. Is there anything I can do against her lame, but frustrating cyberbullying?

When this girl and I first had our fight I told her to not contact me again, and blocked her on the sites I frequented, made my profiles private, etc. Since then I've reported her profiles for harassment and such, and otherwise, ignored her, in all her various hacked accounts.

You can get a protective order against her for stalking. However as in any protective order you have to show there is a reasonable chance of harm and injury to yourself or your property. With the recent stalking situations involving Craig's list, you may not have a problem with that.

 

On the other hand, while the pictures you post may not be suggestive, she may have grounds to sue for posting the picture without permission. It is a violation of the right to privacy of the minor,for whom she is entrusted to care for, and whose privacy she is charged with protecting. It is illegal to publish (emphasis on publish) a photo of a minor without the permission of the parent or legal guardian. When you post to the Internet, you are publishing (see copyright law). Because a parent or legal guardian may change their mind, then at the moment permission is no longer given, (she expresses that it can no longer be posted/published), and it remains, you can be sued.

 

Because of the high risk generally on the Internet of others, not necessarily you, seeing that picture and using it to identify a potential victim, you would most likely lose in court.

 

The argument that you also appear in the picture is not lost. So the question is moot if you are a parent of the child, else it holds true.
