Question

I am a property owner. My property is for sale by partition. I am completely out of control. I have no rights. My attorneys tell me that the tenant and my tenant in common cannot not be made to do anything they don't want to. In the meantime they are devaluing this property so that my partner can buy it at rock bottom.

The court, court appointed property manager, the referee work against me and will not help me. My attorneys tell me if I take a stand I will be seen by the court as hard to work with. I can't get representation. What do I do?

Your attorneys should be demanding an independent appraisal from the court, the problem is with judicial partitions is that often the appraisals from the court are often lower than had the parties worked things out amonst themselves. Many people believe that it is almost like a punishment for people going to court and not being able to resolve their differences on these matters without court intervention. If you have a court ordered appraisal and it is too low, the only other thing you can do is pay for another appraisal and try to argue it with the court.

MY QUESTION HAS TO DO WITH HOW TO GET REPRESENTATION IN A COURT THAT IS BASIS AND MY ATTORNEYS ARE HELPING THE COURT CARRY OUT AN AGENDA THAT IS IN FAVOR OF A LOCAL BUSINESS MAN.

If your attorneys are not properly representing you, then you have a right to terminate your attorney and hire another attorney who will go in and fight for you. This is your right to choose attorneys. Also, if your attorneys have been negligent or you have some proof your attorneys were in collusion with the other party, then you can also file a complaint with the state bar's office of disciplinary counsel.
