Question

My neighbor is a conviced pedifile (importuning) and he is getting out of jail in about a month. His wife runs an unlicensed babbysitting service in their home. She has told us that she will continue to babysit (all children under the age of 4) when he comes home. I would like to know if this is allowed considering he was caught soliciting sex with 12 yr olds on the internet. They also live within 120 ft of an often used puplic family park. She stated that she asked all of the parents about babysitting when he comes home and they said it was ok.   What does the State of Ohio have to say about this?

I am just trying to find out what the laws of Ohio have to say about this convicted pedifile coming into contact with the babysitting kids. She always has children age 3 and under (plus her 2 daughters) in the home. If something happens the kids are too young to speak up for themselves. What are the rules about living so close to a park??

Unlike many states Ohio does not prohibit a sex offender from living within a certain area of children, a park or a school. There are three "Tiers" of sex offenders, and we don't know what "tier" he is in. Generally, he has to register with the sheriff, and the sheriff informs nearby schools. The parents of these children are nuts but I don't believe you can do anything about their poor judgment.

I do know that the tier must be a higher one because the wife is trying to get the reporting requirements reduced. I find it hard to believe that she would be legally allowed to put those children in contact with her husband. I don't believe she has told the parents the truth. Would this be considered child endangering?

Answer

The tier depends on which of about 100 different laws he was convicted of. She cannot get the tier changed and the sheriff cannot alter the reporting requirements of the tier. I cannot say that her actions are child endangerment.
