Question

I am being sued by amex credit card company for $75K. The credit was in my company name and my name. They served complaint by mail to new tenent of my old residence address in March 09. Now I have recieved proof of service in mail (forwarded from old address) for case management on June 25th.    This is in California court in San mateo county.

I would like to delay this action as long as possible while sorting out my company's business viability.

Your best bet is to retain an attorney, and ask him to file a continuance on your behalf, citing that you were only recently served, and you need to collect all documentation to bring to court. In that situation, courts are generally open to allowing for a short delay.

Contact the clerk of the court in which you need to appear. Ask the clerk what forms they specifically request from someone who will be appearing "pro se" (meaning representing themselves) and how to get a continuance filed and then granted.
