Question

In 1994, my partner and X wife had a very good business year. It was all my doing and I can prove that part. She had a financial planner come see her, as she was President of the Corp. He told her she could shelter $15,000.00 so as not to have a tax burden. I was in the meeting and know the Advisor.

As she was signing the check, she turned to me and said, "Half of this is yours" In the presence of the Advisor.

In 1999, we sold the company and I got half of the selling funds. I then asked her about the $7500 and she said she was going to keep it as she had bought two IRA's in my name. At the time of the IRA's, we were not doing well financially and I had to cash them out to survice.

Since I cashed out the IRA's, she said I was irresponisible and couldn't handle money. We have tried to mend things back, but it has come to the point it can't happen.

Do I have a legal leg to stand on?

Answer

That was a promise of a future gift and it is not enforceable. In addition I assume that you have since divorced and the divorce settled all the issues between you. You could have brought it up at the time.

We were divorced at the time, but stayed in business together until 1999.

Answer

Still it was a promise of a future gift. Even if it was enforceable as a contract, the statute of limitations has expired.
