If you never gave your old doctor consent, either in writing or verbally, to provide your chart/records to the new doctor, then it does appear to be a HIPPA violation. However, before initiating any claim, I would recommend that you review any and all paperwork received from the old doctor's office which you have signed which may contain language authorizing such an information transfer.
Otherwise, the only person who can waive the doctor patient privilege is you, the patient.
