Question

I was married sept 22,2008 separated july 5,2009 with a mere 6 month egagement before hand. My husband had a nervous breakdown within this time where i stood by him from mental instution stays to harassment of his family, to his own abuse(including a restraining order) ,then even harasment from another woman. During this time i was able to get his retirement started as well as his social security. The doctors diagnoises was that he would not walk or talk anymore. I walked every evering, cooked, adminstred medicines, ran to doctors visit all after a working a full time job trying to keep the house going. He walked away as soon as he was well enough. My daughter(not his) is currently receiving 165.00 ss check on his behalf. He has now sent divorce paper where we simply walk away. I want to find out am i entitled to anything for his abandonment including the request that my daughters benefits not be stopped? Can you suggest direction for me?

Answer

I'm sorry to provide bad news, but you likely are not entitled to much here. As you indicated, the relationship was short, the engagement was short and the marriage was short. Typically to receive any support after a divorce, there is a requirement for a long-term marriage and/or relationship. If I'm understanding you correctly, the marriage was about 9 months. (The separation date you listed is incorrect as today's date is June 3, 2009.) You do have the right to contest the divorce action and fight for anything you might be entitled to but you just don't have any realistic expectation of prevailing. I would suggest considering the uncontested divorce action and resolving the matter quickly and cheaply.
