Question
If I have a 501C (home for transitional veterans, between treatment facilities) and a veteran makes a $200. donation in exchange for a place to live and the 501C provides the veteran with a receipt for the donation, can the veteran receive a tax write off for the contribution?
Proposed senerio: $200 donation permits veteran to live at the 501C for any portion of a month (1-31 days). All expenses other than a house to live in wih accomodations provided are at the expense of the veteran. 501C provides facility insurance, and utilities
Veteran provides food clothes and other needs as determined by the veteran

I am preparing to set up a 501C (Home for Veterans who are in transition between treatment facilities) and have not paid the fee to get set up as a tax exempt entity. I have the house and hope to pay the fee, get 501C status and accept donations to prepare the facility for use. I just am brainstorming the best arrangement for all steps in the process. Any further guidance for having a self service 501C facility will be appreciated. Dan

Hello dannelson,
When someone makes a donation to a qualified not for profit organization, if they also receive a benefit of any type in return, then they may only claim a deduction for the part of their donation which exceeds the fair market value of what they received in return for the donation. So if someone gives you a donation of $200, and in return you give them a place to stay for up to 31 days, then in all likelihood, none of their donation would be deductible, as I am certain the value of housing for 31 days would far exceed the $200.
However, something else to keep in mind is that in order to even claim a deduction for a charitable contribution, you must have enough income to file a tax return and you must have enough deductions that you are able to itemize. If these veterans are currently unemployed or only working part time or otherwise have limited income, then a deduction for a charitable contributio is really of no value to them to begin with, as they are not likely even subject to any income taxes.

Thank you dannelson.
