Question

My son was charged as a minor in possession of alcohol in the state of Maine, but is a Massachusetts resident. He was not issued a breathalyzer or given a sobriety test, and had only been present in the company of otherswho were drinking. It is a civil offense in Maine, but what are the ramifications to him in Massachusetts?

Hello,

Your son will have no ramifications from this charge in the state of Massachusetts. A minor in possession of alcohol is a civil offense in Maine, so the charge won't even appear on his record. Once he takes care of the case in Maine, it's finished. For a first offense, the fine is $200-400.

My son was told by the school police officer that he could lose his license for 3 months in Massachusetts if he is found guilty of the charge. Also, he was not driving at the time. I am concerned that the officer is correct, and why did the list of those charged go to our city's police department?

Since this is a civil offense in Maine, there shouldn't be a finding of "guilty" or "not guilty" as in a criminal case, so I'm not sure why your city police department was made aware of this.   

I will opt out so that another expert with more knowledge of Maine and Massachusetts laws can provide some input.
