Strictly speaking, since you're not married then you can move. HOWEVER, if you move without either permission from the father or court, the father can file a custody petition alleging Parental Alienation, claiming that you're interferring with the father-child bond. Such a claim can lead to a custody battle that can easily be avoid by seeking permission from the court in advance of your move.
