Question

For Mr. P Simmons or some other attorney: I just had a car accident. Hit a pedestrian that I did not see. She is at the hospital, cop told me she is doing fine, but he does not know much yet. I was going slow - have insurance, have contacted insurance and they are filing a claim with their insurance attornesy. I am a secretary, never had any problem driving except one ticket years back. Clean record. I have a mortgage and a small home. I am afraid that she will go after the home. What do I do?

So far I have contact my insurance and they have given me a claim, have called the police officer to see how she is and have calledt the court for the citation but they told me I must wait until June 1st.
What I need to know is can she go after my home on which I do have a mortgage. I have no moneys as I am a secretary but I don't want to lose my home. Farmers told me that in case of a personal lawsuit they will provide with me with an attorney and that they do make her sign a release form after she is paid that she cannot go after them or MYESLEF. IT IS THE ATTER THAT WORRIES ME. PL CALL OR EMAIL - MY CELL XXX-XXX-XXXX I AM IN THE STATE OF UTAH, USA

I am very sorry to hear of this accident. You must be really shaken up.


Based on the information you have provided, that she is doing OK, it is very likely that any settlement or judgment would not exceed your policy limits. Your insurance company also has a duty to defend you in any negotiations or lawsuit, so you should not lose your home or other assets.

 

Your insurance rate will likely go up, but other than that, you should not suffer any other financial repercussions from this. I would just be very happy that no one was seriously injured.

In response to your feedback question: You can always ask for me Tina G or the system allows you to select an expert if you wish. Yes, you will need to wait and see now what kind of demand the pedestrian makes against your insurance company and go from there.
