Question

I have had my 2004 Grand Am since December, 2003: 100,000 / 60 warranty - has expired. I take my car to the same dealership where purchased for everything including oil changes & tire rotations... I have had a lot of problems with it...Blew both head gaskets @ 60,000 mis, and they kept my car for a week. Also, have had the cd player replaced twice & still doesn't play right... (plays a song for 1-2 seconds, then starts over); @ 45,000 mis, I complained that I was having some transmission slipage and that it felt like it needed a tune-up, but was told that tune-ups are scheduled @ 100,000.   Not sure that the car will make it that far before something else MAJOR goes wrong... now @ 71,650 mis., I am wondering if I should persue the "lemon law" before I get myself in financial straits with another repair.... your unbiased opinion would be appreciated.....

Answer

to be honest i live in ohio and have had a vehicle that should have been a lemon law candidate but it has to be min for the same repair at least 3 times without resolving the issue and they have to be of a certain type of repair to be under the law i find the law useless mine was a 2002 trailblazer 1 year old 10k and in the dealer 18 times and tey said it didnt fall into the cattagory so i think the law is bs

My real point with the dealership (Capital Pontiac, here in Richmond, VA) is that a service tech had driven the car, and noted that there was a transmission issue, but would not suggest a repair. Like I mentioned in my original statement to you, the warranty expired in December 2008 -- the service tech had driven it as much as 12 months prior & noticed a problem. Now I may be looking @ a $2,000.+ repair job to get the car operating sufficiently & reliably. It seems that I should have some kind of recourse here, as I have ALL of the service receipts. I love the "look" of the car. I keep it immaculate both inside & out. But looks are deceiving, and I want the operation of the car to coincide with the appearance! Any ideas of how I get the dealership to take some responsibility???

Answer

if the tech made the coment verbal you would have to see if you can find himand see if he will testify and then you can file a claim with the bbs and see what happens if it is in writting then they should do it for you at the dealership if not then the bbs or the courst but you need proof eather written of the techs testimony

My concern with the transmission's operation was noted on a service ticket; maybe more than one. I can tell you that within a month's time (back in November / December 2008) prior to warranty expiration, I must have had the car @ the dealership 5 times - replacing that cd player, which still doesn't work right twice, plus other repairs.... I believe that with my patience, sitting in their waiting room for hours on end, they should be more than willing to work with me in getting the car operating sufficiently with minimal cost to me. I am sure that the service manager was GREATLY aware of the date the warranty would expire...and that thought was in the forefront of his mind every time he saw me coming......

Accepted Answer

if you have those service tickets and all the other papers ask for a meating with the owner and see what he says if not call the bbb and see if the can arbitrate with the dealer
